“ARCADE FIRE FLYAWAY” CONTEST
RULES AND REGULATIONS
- Eligibility
The “Arcade Fire Flyaway” contest (“Contest”) is open to legal residents of British Columbia who have reached the age of majority at the time of entry and have all necessary travel documentation required for travel to the destination for presentation to airport staff. Employees, officers, and directors (including immediate family members and members of the same household) of Pattison Media Ltd. operating 102.7 The PEAK (the “Sponsor”) and Sony Music Entertainment Canada Inc. (the “Prize Provider”) and their respective distributors, dealers, marketing representatives, printers, advertising or promotional agencies, or any other organization associated with the Contest are not eligible to participate. If after comparison with out records Sponsor finds that a winner has won more than one prize from the station within 30 days of each other or has been untruthful in their communications with the station, Sponsor reserves the right to disqualify the winner from any prize above and beyond the first and potentially any future prizes. Exception can be made to the 30 day rule in cases where a major contest (vacations, large cash prizes, etc.) falls within 30 days of a prize win. A person can be eligible to win a major prize within 30 days of winning a small/daily prize, with discretion provide to the on air announcer facilitating the contest at the time of entry. However, when a major prize is won first, no exception will be made to the 30-day rule.
- How to Enter the Contest
No purchase is necessary to enter. The Contest begins June 13, 2022 at 6:00 a.m. Pacific Time (PT) and closes at 11:59 p.m. PT on June 19, 2022 (the “Contest Period”). Eligible entrants must have the 102.7 The PEAK App downloaded to any of their computer, mobile, tablet and/or smart home devices, or download the 102.7 The PEAK App for free from the AppStore or Google Play. To enter the Contest, listen to 102.7 The PEAK from The PEAK App during the Contest Period and when the station airs a secret code word, that is your cue to submit the word on The PEAK App to qualify to enter the prize draw. The station will air a different code word multiple times per day during the Contest Period (between 1-4 times per day). The code words will be theme around Montreal or the music festival (e.g. French words). All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Contest rules and regulations may be disqualified. Limit up to 28 entries per person (1 per code word. The Sponsor is not responsible for any lost, delayed, illegible, incomplete, misdirected, damaged, destroyed entries.
- Prize
One (1) grand prize (the “Prize”) is to be awarded consisting of:
- roundtrip economy airfare for Prize winner and guest departing from Vancouver BC to Montreal QC;
- four (4) nights hotel accommodations in Montreal (arrive July 28, depart August 1st);
- two (2) three-day Osheaga festival passes (Arcade Fire headline the first night of festival); and
- one (1) vinyl copy of Arcade Fire’s new album “WE”.
(Approx. retail value of Prize $3,800 (CAD)
- To be eligible to participate in the Prize, Prize winner’s accompanying guest must have reached the age of majority and have all necessary travel documentation required for travel to the destination for presentation to Canadian airport staff.
- Prize winner and accompanying guest agree to comply with all regulatory COVID-19 guidelines at their own cost, including but not limited to mandatory vaccination requirements, mandatory masking requirements, and mandatory COVID-19 PCR and/or antigen testing, as required.
- All transportation to and from departure and arrival airports, other ground transportation except as otherwise specified herein, departure tax, travel documentation including but not limited to a valid passport, COVID-19 vaccination proof and negative COVID-19 test, as required, insurance, fuel charges, travel related fees and items of a personal nature, including but not limited to food, beverages, room service, wine and bar charges, gratuities and local and long-distance telephone calls, are the sole responsibility of the Prize winner and accompanying guest.
- Prize winner and accompanying guest must travel on the dates specified by Sponsor and Prize Provider in their sole discretion. Should Prize winner and guest be unable to travel on the dates specified by Sponsor, the Prize will be forfeited and awarded to an alternate winner.
- Prize winner and accompanying guest must travel together on the same itinerary.
- No change in travel arrangements can be made once the booking has been confirmed.
- Sponsor and Prize Provider reserves the right to change or cancel the booking and to vary itineraries and to substitute hotels in accordance with operating requirements or circumstances beyond their control.
- Travel and accommodations are subject to availability, blackout periods, government restrictions and regulations, hotel, airline, airport or other transportation restrictions and regulations.
- Sponsor and Prize Provider are not responsible for any other travel arrangements affected due to cancellation, changes or rescheduling of any dates and Sponsor and Prize Provider reserve the right not to cover costs related to missed/delayed flights.
- A valid major credit card must be provided by the Prize winner or accompanying guest for hotel check-in and incidentals
- It is recommended that the Prize winner and accompanying guest obtain sufficient personal insurance prior to departure.
The Prize winner and accompanying guest are solely responsible for all costs not expressly described herein as being included in the Prize. The Sponsor and Prize Provider will not be responsible if weather conditions or other factors beyond their reasonable control prevent a Prize or part of a Prize from being fulfilled. Further, the Sponsor and Prize Provider assume no liability or responsibility whatsoever should the Prize winner or accompanying guest be denied entry to the airline or music festival for any reason whatsoever. In the event government regulations/ public health advisories / recommendations related the COVID-19 pandemic impact the travel period of the Prize in the sole determination of the Prize Provider, the Prize Provider will make reasonable efforts to coordinate a rescheduled date for the flights with the Prize winner. If the Prize Provider is unable to reschedule and provide any portion of the Prize because of such regulations or related circumstances beyond its control, then the Prize shall be deemed fulfilled and will not be substituted, except in the sole discretion of the Prize Provider.
The Prize Provider reserves the right to substitute the Prize in whole or in part for a prize of equal or lesser value if any component of a Prize is unavailable for any reason. Prizes must be accepted as awarded and no substitutions, except as identified above, will be made. Prizes may not be sold, transferred or assigned and are not convertible to cash.
- The Draw
On June 20, 2022 at 6:00 a.m. PT, the Sponsor will conduct a random draw to select one (1) eligible entrant as the potential winner of the Prize from among all eligible entries received by the end of the Contest Period. The odds of winning depend on the number of eligible entries received. The Sponsor will attempt to notify the selected entrant by phone and email within 24 hours of the draw. In order to be declared a winner, the selected entrant must unaided correctly answer a mathematical skill-testing question and, within the time specified by the Sponsor, complete and return to the Sponsor and Prize Provider a Contest eligibility and liability/publicity release confirming compliance with these rules and regulations, releasing the Sponsor and Prize Provider and their respective directors, officers, employees and agents from all liability and, except where prohibited by law, permitting the Sponsor and Prize Provider to use the selected entrant’s name, address (city and province), likeness, voice, written statements and image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsor and Prize Provider. Selected entrants and accompanying guest must also provide proof of identity (photocopy of Driver’s License, Passport or any other government-issued photo identification). If a selected entrant is not eligible for any reason, has not correctly answered the skill-testing question or cannot be contacted after one day of the first attempt to contact the selected entrant, such entrant shall be disqualified, and the Sponsor shall have the right to select another entrant and the Sponsor shall be released and discharged from any liability or responsibility in this regard. No correspondence will be made except with the selected entrant(s). All entry forms submitted become the property of the Sponsor and will not be returned.
- General
By entering the Contest, entrants agree to abide by these rules and regulations, and further agree that the decisions of the Sponsor are final. The Sponsor reserves the right at any time without prior notice to withdraw, cancel, terminate, amend, modify or suspend the Contest if for any reason in the opinion of the Sponsor, in its sole discretion, the Contest is not capable of operating as planned or if the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, printing error, or any other causes beyond their control. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the online entry process or the operation of the Contest or to be acting in violation of these rules or otherwise in disruptive manner with respect to the Contest. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. The Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software (including on account of traffic congestion on the Internet or at any Web site) or any combination thereof. The Sponsor shall not be liable for any errors or negligence that may arise or occur in connection with the Contest, including any injury or damage to the entrant’s or any other person’s computer related to or resulting from participation in or downloading of any materials relating to the Contest or any theft, destruction or unauthorized access to, or alteration of, entries submitted online. The Sponsor and Prize Provider are not liable for injuries, death, damages or losses of any kind resulting from acceptance or use of the Prizes. In the event of a dispute, entries submitted online will be deemed to have been made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.
- Privacy and Personal Information
The Sponsor will be collecting data about entrants through the Contest entry forms for the purposes of implementing, administering and fulfilling this contest. Any personal information will be handled in accordance with the privacy policy of Pattison Media Ltd. located at https://www.thepeak.fm/privacy/. By entering the Contest each entrant consents to the collection, use and distribution of their personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling the Contest. Any inquiry concerning the personal information held by the Sponsor should be addressed to Pattison Media Ltd., 460 Pemberton Terrace, Kamloops, BC V2C 1T5.
- Publicity of Winner’s Name
The name of the Prize winner may be announced on air and may be posted on Sponsor’s website and social media.
- Subject to Applicable Laws
This Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
